The present conditions of sale (hereinafter simply “General Conditions”) govern the sale of products marketed by Colesel Spumanti s.r.l. (from here on out, for the sake of brevity, simply “Colesel“) via the site www.colesel.it (hereinafter “site”). All contracts for the purchase of products concluded via the website indicated above will be governed by these General Conditions (in accordance with Italian law and in particular with Legislative Decree 70/2003 implementing Directive 2000/31 / EC on the subject of electronic commerce and to Legislative Decree 206/2005 with specific reference to the legislation on distance contracts).
Any changes or new conditions of sale will be promptly reported to the Customer, will be effective upon their publication on the site and will be applied only to sales concluded after publication.
All published prices are inclusive of VAT.
Acceptance and conditions of sale
The contract stipulated between Colesel and the Customer, must be considered concluded with the acceptance of the order by Colesel which, in its unquestionable judgment, reserves the right to accept the order. Acceptance is considered tacit, unless otherwise communicated to the Customer in any way.
By placing an order, in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the General Terms and Conditions transcribed below.
Once the online purchase procedure has been completed, the customer will print, or save a copy on an electronic medium, or in any other way in any other way, to keep the following General Conditions.
How to purchase
The Customer can only purchase products in the electronic catalog that can be consulted on the site at the time the order is placed, as described in the relevant information sheets.
The technical information on the site faithfully reproduces those of goods included in the catalog. Colesel reserves the right to modify the technical information of the products, without any prior notice. The photographic representations accompanying the description of a product may not perfectly represent its characteristics, differing in color, size, and / or accessory products shown in the figure.
The recognition of a contractual and / or non-contractual liability is excluded, and with it the right to compensation or compensation, for damage caused to people and / or things as a result of Colesel’s failure to accept the order, even partial, ;
All purchase support information is intended as a simple generic information material.
Correct receipt of the order is confirmed by Colesel by an e-mail reply sent to the e-mail address previously indicated by the Customer. This confirmation message will contain Date and Time of receipt of the order, a ‘Customer Code’ identifying the order that must be used for any further communication with Colesel and all data entered by the Customer at the time the order is forwarded. The Customer, with reference to the latter, undertakes to verify its correctness and to promptly communicate any corrections with the methods that will be included in this document indicated.
In case of non-acceptance of the order, Colesel will promptly communicate it to the Customer by e-mail to the e-mail address previously indicated.
All prices on the site are to be intended as public prices and, therefore, inclusive of VAT. Colesel reserves the right to change prices at any time, without notice. In the event that an incorrect and / or clearly insignificant price is published, for any reason, the order will be canceled, even in the event of initial validation.
Shipping costs of € 0.50 are included for each item in the order.
The possibility of simultaneous access by multiple users to the site and to execute multiple “on-line” orders at the same time could quickly change the availability of the product; Colesel, therefore, does not guarantee the effective availability of the ordered goods even if this is indicated, at the time of the order, as “available”. Colesel, if for these reasons the product should not be available, although otherwise indicated at the time of the order, will promptly notify the Customer by e-mail to the e-mail address indicated by the latter at the time the order is forwarded.
On certain products, subject to price promotions, Colesel reserves the right to accept orders by reducing the quantities, upon notice and acceptance by the Customer, failing which the order will be considered canceled.
TERMS OF PAYMENT
The customer can purchase the products on the site using the different payment methods indicated in the purchase procedure. Any additional costs relating to a specific payment method will be explicitly highlighted during the purchase process itself.
Colesel delivers its products through specialized couriers. The products within 3-5 working days from receipt of the order will come from Colesel entrusted to the specialized courier.
The shipping costs, in general, are charged to the Customer and are expressly indicated at the time the order is made.
Upon receipt of the goods, the Customer is required to verify its integrity and, should he have doubts about the integrity of the same, he must indicate this on the delivery receipt.
The Customer will have time 10 working days from receipt to verify the integrity of the goods and to communicate any damage to Colesel at the e-mail address email@example.com. Colesel will refund the Customer within 10 working days from the communication.
Right of withdrawal
If the Customer is a consumer (ie a natural person who buys the goods for purposes unrelated to his business, commercial, craft or professional activity) he has the right to terminate the purchase contract for any reason, without penalty and without obligation. to specify the reasons, within 14 working days from the acquisition of physical possession of the goods.
To exercise the right of withdrawal, the Customer must send a written communication to Colesel by registered letter with acknowledgment of receipt containing clear and explicit desire to exercise this right, however manifested. The communication may be sent, within the same period, also by telegram, e-mail and fax, provided that it is confirmed by registered letter with acknowledgment of receipt within the following forty-eight hours. The communication must also indicate the bank details necessary to return the sums paid in addition to the “Customer code” identifying the order made. Colesel will send to the Customer via e-mail (to the e-mail address indicated by the Customer at the time of registration or order execution – unless the Customer expressly indicates for this purpose, in the first communication, one different) a paper form containing the withdrawal authorization number that must be printed and attached to the outside of the envelope in which the product will be physically placed. All must be sent, with shipping costs exclusively charged to the Customer and within 14 working days, to the address indicated therein.
The right applies to the product purchased in its entirety as it is not possible to exercise withdrawal only on part of the product purchased.
The purchased good must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation).
The shipment, until the certificate of receipt by Colesel, is under the full responsibility of the Customer; in the event of damage to the goods during transport, the Customer will be promptly notified of the incident (within 5 working days of receipt of the goods by Colesel), in order to allow him to file a timely complaint against the carrier of his choice and obtain reimbursement of the value of the asset (if insured); in this case, the product will be made available to the Customer, simultaneously canceling the request for withdrawal; Colesel is not responsible in any way for damage, theft or loss of goods returned by uninsured shipments;
Once the right of withdrawal has been exercised, Colesel will reimburse the Customer the full amount already paid, in the shortest possible time and in any case within 14 days from the date of receipt of the withdrawal notice, upon receipt of the goods subject to the withdrawal, by means of the transfer cancellation procedure. the amount charged to the credit card or by bank transfer. In the latter case, the Customer will promptly provide the bank details on which to obtain the reimbursement (Cod. ABI – CAB – Current Account of the invoice holder). The Customer will be reimbursed for all payments made to Colesel, including delivery costs (except for the additional costs deriving from the choice of a type of delivery other than the least expensive type of standard delivery offered by us).
If the goods have suffered a decrease in value due to a non-diligent use, in the case of exercising the right of withdrawal, the consumer will be held responsible for the lower value. The costs and risks of transport for the return are fully charged to the Customer.
In the event of forfeiture of the right of withdrawal Colesel will return the purchased good to the sender, charging the shipping costs to the sender.
All products marketed by Colesel are covered by the legal guarantee of conformity pursuant to Legislative Decree n. 206/2005. To use the warranty, the Customer must keep the invoice (or DDT) he will receive along with the purchased goods. The Customer can always download the invoices relating to his purchases, by accessing the appropriate area of the site reserved for him.
In the presence of a lack of conformity, the consumer has the right, at his choice, to repair or replace the defective good by the seller, without charging any costs in both cases, unless the requested remedy is objectively impossible or excessively expensive compared to other. If replacement or repair are not possible or excessively burdensome, the consumer is in any case entitled to a reasonable price reduction or termination of the contract.
The legal guarantee of conformity has a duration of two years from the delivery of the goods and must be asserted by the consumer, under penalty of forfeiture, within two months from the date on which he discovered the defect.
In the event of a dispute, Colesel undertakes to:
- take the defective product to check whether the malfunction depends on a lack of conformity. In particular: (i) for defects that occur in the first six months from the date of delivery of the product, the verification is always the seller’s responsibility as it is assumed that they existed at the time of delivery; (ii) subsequently, in the sole case in which the malfunction does not depend on a conformity defect, the consumer can be asked to reimburse the cost – reasonable and previously indicated that the seller has claimed for the verification;
- once the lack of conformity has been found, carry out the repair or replacement of the goods within a reasonable time from the request and without charge to the consumer.
The personal data requested when the order is submitted is collected by Colesel and processed on computer media, in order to satisfy the obligations arising from the contract concluded with the Customer and will in no case and in no way be transferred to third parties. Colesel guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code pursuant to Legislative Decree no. 196/2003. The data controller is Colesel, Via Vettorazzi and Bisol 4, 31049 Valdobbiadene Italia, in the person who from time to time has legal representation, unless a manager is appointed pursuant to art. 29 of Legislative Decree n. 196/2003. The Customer, at any time, has the right to withdraw the consent to the processing of personal data by written notice to be sent to the registered office of Colesel. To the Customer, who declares to have received the information pursuant to art. 13 and on the rights due to the same, pursuant to art. 7 of Legislative Decree no. 196/2003, has the right to access their data according to the methods provided therein. Marketing communications will be sent only with the explicit consent of the Customer issued together with the processing authorization and the dispatch in the online registration form.
Protection of minors
Colesel does not sell wine or other alcoholic products to persons under the age of 18 pursuant to Law 8 November 2012 n. 189. The courier will not deliver wine or other alcoholic products to children under the age of 18 and may request an identity document in order to verify their age.

JURISDICTION AND APPLICABLE LAW
The sales contract between the Customer and Colesel is concluded in Italy and regulated by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial competence is that of the reference forum of his municipality of residence; in all other cases the territorial jurisdiction is exclusively that of the Court of Treviso.
